A new situation for Brits in Denmark
EU has extensive rules for free movement for individuals within the EU member states and since U.K. has now left EU, this leaves Brits living in Denmark in a new situation, because they are no longer EU citizens.
Denmark has wanted to secure that Brits who have come to Denmark as EU- citizens and who contribute to the Danish community still should feel welcome. In the spring 2019 a new Brexit law was enacted, under which Brits living in Denmark are secured right to reside and work in Denmark, if they are properly registered on 31 January 2020.
This means e.g. that Brits expatriated to Denmark can continue their work as agreed from arrival. At a new posting agreed after Brexit on 31 January 2020, however, Brits are to meet the conditions in the law on foreigners (“udlændingeloven”).
A transitional rule being in force to the end of 2020 secures, that British citizens can travel in and out of Denmark, but when this rule has expired, Brits are to be handled as other third country citizens. This implies that Brits can not use the scanners with automatic passport control in the airports, but will have to go to the manual passport control, in which the passport is stamped.
Most Brits have an EU registration card and residence card and these will still be valid until otherwise determined. If an EU residence card has not been obtained, it is a good idea to get it procured. Being a Brit you just are to prove, that you are entitled to reside in Denmark as at 31 January 2020. The residence card can be obtained at “Styrelsen for International Rekruttering og Integration”.
Taxation of British Citizens living in Denmark
Danish taxation of Brits in Denmark being subject to Danish taxation will not be changed due to Brexit, since the tax rules are not regulated by EU but exclusively by internal Danish rules and the double taxation agreement between UK and Denmark.
Social security for Brits living in Denmark
Even though UK has now left EU this will not influence the way Brits residing in Denmark are treated for social security purposes. Thanks to a transitional rule they have the same rights at least till the end of 2020. This means they are covered by the yellow and the blue social security card until 31 December 2020.
If you reside in Denmark being a British pension receiver, you still you still have the right to use the British health care system, when being in UK. But please be aware that special treatment in a hospital in the UK is subject to special rules of prior authorization.
